Im just an electrician but the NEC is the minimum required.

Sometimes the NEC is wrong.

AHJs can make codes more stringent but cannot lower standards below of what is required per the NEC.

Sure they can.

One thing that slides by here all the time is rooftop AC circuits.

Up until the late 80's early 90's, everyone here used SE cable for the AC circuits. When #8 and #6 NM came onto the market, everyone started using it instad of SE.

Typically, about 2' of cable stubs up thru the roof and hits the AC disconnect but no one really cared about it. There MAY be a specific local variance but I think it was basically a non issue and no one thought twice about it.

my question is why do you run nm through conduit when you can instal thhn instead and advoid all the hassel. you can save partial rolls for just these types of installs?

For my part, under the '02, I'm guilty of installing NM in short runs (maybe 6' or less) in EMT or PVC, when upgrading panels from a bedroom closet to the the outside. Also, I have installed short stub outs into A/C discos.

Let the flogging begin.

A lot of small time shackers/side job jockeys don't have room for THHN in the trunks of their car.

People used the NM through conduit because it was already there. We used to leave enough NM hanging outside the house to make up the whip to the AC unit on the trim. Less trips to the truck. More efficient. Less labor.

If it was still legal I would still do it this way.

you make good point when I bbought the whips premade I do not remember if I ever pulled the wire to see what they used.

I call it thhn when it has a thermoplastic covering and is rated thhn or thwn. my bad I keep forgeting that we need to be specific here.
