Oven Uppgrade

This question is regarding my own home...
I recently put in a double "stacked" oven. There is no other load on the double pole 50A branch circuit. The nameplate rating is 7.2 KVA and the manual "recomends" a 40A breaker. Is it Manditory by the NEC to replace my 50A with a 40A?

I would say no, since your 50A breaker meets the requirements for the maximum current draw of the ovens. What size are your conductors for the circut?
A 50A branch circut would require #8 conductors.

The maximum circuit breaker size is 150% of nameplate current. However, a 45 amp branch circuit is not a standard size branch circuit so you are allowed to go 50 amps.

For type NM cable a 50 amp circuit requires #6 copper. Since SER cable is allowed to go 75 Celsius and every 50 amp receptacle that I have seen has 60/75 Celsius terminals, you could go #6 aluminum but you would be better off using #4 aluminum for this application.

240.6 has listed a 45A bkr. for several years now.
Easy to get for commercial/industrial type panelboards.
Maybe not quite as readily available for dwelling unit panelboards, but Square D Digest shows them.
