Here is the scenerio, commercial building, 208/120V 3PH 4W service. Feeding sub panel with 4- 500 MCM and ground from MDP.

MDP has a 400A breaker to protect the feed.

Sub Panel is in different section of the building, that has a different street number. MDP is in 1 Main St., sub is in 2 Main St. Both buildings owned by same customer and share a common wall.

Sub Panel in 2 Main St, has a 500A MCB.

My question is, are there any exceptions that would make this installation illegal?

If I understand this correctly then the only reason it may not be up to code is if the buildings are considered separate structures. In this case then ground rods would be needed at Bld #2 as well as a main breaker.

There may be some other issues that are building code related.
 
IMO if the two buildings are sharing a wall then the structures are attached and not separate.

I agree but isn't there something in the building code about fire walls changing that status

I can see it either way. But IMO the introduction of a firewall doesn't automatically make one building into two or more. Many commercial buildings have many fire rated partitions which do not make them into many smaller buildings.
