I say no.

110.26(A)(3, The work space shall be clear and extend from the grade, floor, or platform to the height required by 110.26(E).....

what if it was not a countertop but something moveable such as a dryer

I still say no. The working space shall be clear with sufficient access.

Even though it can be well argued that the provisions of 110.26 are never required, good judgment and common sense should prevail. :)

No clue why this posted here - it was intended for the discussion on Joe Tedesco's photo of the AC disconnect behind the condensor)

I'm in the camp that says the AC disconnect needs working space. The key to me is the part in 110.26(A) when it talks about working on the equipment while energized, which AC techs do. A worker in Chicago was killed a couple years ago on a setup like that in Joe's photo, reaching across the equipment.

I thought the change in 1993 to require the clearance to extend to the floor was intended to address the issue in Joe's photo.

I agree with all of you that there needs to be the clearance for working space. Some AHJ's in NE Ohio have allowed a washer or dryer to be in front of the panel in an existing situation, considering the appliance as movable. I think that the application should be carefully looked at and if possible to relocate the appliances.
