In a residence, if you install a 200 amp breaker and can beside the meter as the service disconnecting means, then run an SER feeder to a panel located in the house, are you required to install a main breaker in the panel? We have a little disagreement going on about this with an inspector right now. I used 408.36 as my reference.

assuming the SER is sized properly and the interior panel is rated 200 amp, your installation appears to be code compliant with 408.36

Yes, it is the same structure. He could not give me a reference, so I may take this to the electrical board for clarification. I just wanted to make sure I was not missing something here.

I suggest pointing out the last sentence in 408.36(B). The overcurrent device protecting that panel can be anywhere upstream of the panel.

All you did was build a meter/main (the hard way) feeding a MLO sub.

Perfectly legal. Probably half the apartments/condos in the country are done in similar manner.
