Ohhhh, well in that case I agree, you have a valid point.Oh, no, I could care less where you put the panel, within the code of course. I was answering the, if frogs had wings question......frogs having wings is the same as trying to enforce 90.4, probably not gonna happen.
I find this requirement rather silly. A panel in a basement or garage can have wood, cardboard boxes, spray paint, paint thinner, gasoline or a list of any other easily ignitable materials around it. Are covered panels typically spewing sparks all over the place?
