I'm an avid reader of Construction Claims Monthly. I have seen over and over again that unless the contract or RFP tell you how to resolve plan/spec conflicts then the contractor has a duty to seek a clarification prior to submitting his proposal. If no pre-bid clarificaion is sought then the contractor has no say in what the owner selects. The only exception to this would be to stipulate what you are including in your proposal to resolve the conflict if it does not disqualify your bid.
