Its commercial : lots of loading possibilities like FL signage, halogen hallide lamps for ambience lighting,(are there big ovens)
If the feeder route is long & exposed to hot weather( four 250C can be crampy on 3" conduit)
if the 350 is more than 10yrs and in constant use
finally
if the owner likes to pay for the extra labor cost
Upgrade to 500.
if not, why waste the 350

I agree that the neutral does not have to be counted, unless allmarc can clairify if harmonic loads are present. If the commercial building is loaded up with flourescent lighting - then the neutral counts, and things need to be adjusted up.

I'm a little concerned what's "downstream" of this 400A OCPD that he's brought in to the mix. Is there potentially an issue there?

If not, take a look at 240.4(B)(1)

That is the section I was referring to. :)

don't worry
The inspector is making us repull 500mcm in leau of the existing 350mcm

He is also making us install main breakers in every panel even though the electric panel next to the sub panels has the breakers for each panel in there

This guys a piece of work
