Your right Jim, this particular issue is a real head scratcher. :D

There are a million ways to read that..... :D

Jim, opinions are great, we all have them. :cool: All I am suggesting is that sometimes look at the NEC before you hit the "Add Reply" button.

This wet location issue is black and white, there is no gray area, a quick look at the NEC and you would have seen that.

In your 2nd post you were telling us the slab was a dry location because of the poly implying that the PVC was also in this dry location.

Then later you admit it is in contact with the earth meeting the definition here.

NEC-2005 100-Definitions.

So, when you read the first word, "Installations" how do you interpret the rest of the paragraph?

From pulling up a year ago post by Allen i see that the county was aware of this practice of using nm.Why if it is crystal clear did it take them a year to deside to enforce this ?Seems i was not the the only one confused.After reading 300.5 d5 i do see my error.

I think it is awesome that the county would issue a letter regarding their oversight, and giving fair warning that it will not be overlooked any more.

I hope that AHJ's reading this will take this example into consideration, when a discovery is made.

I've been here a short time, but after my discovery regarding this issue it has come up a few more times, suprising everyone who walks in the door. That it's overlooked is common, but not intentionally, as has been hinted at by some others here. It's just hidden in plain sight.

To discredit it as unimportant is tragic. If noone noticed 310.16, would it be safe to put a #14 on a 100 amp breaker? No. Would the "passing" house be the proof that it's safe? Sillyness.

Jim your company if have pulled permits within this particular county has recieved this letter,If you like i will scan and send it to you via email.uf/use type wire is on the top of the letter along with all receptacles being gfci protected in a garage even freezer receps unless the appliance is there on final and all homes with a side entrance as main entry will have a wp recep within 3 ft of furthestmost point of home to comply with required wp gfci receps. :)

I think it would have to be "ratchet fingers" or "motor digits". ;)
