This is funny, because I asked a similar question a few months ago about transformers and disconnects mounted 20- 30 feet up in the air at places like Home Depot and Lowes.

Assuming the disconnect for the secondary contains the OCPD, and the panel below it does not contain a main (why should it?), then I think there are an awful lot of violations out there. :(

Next time I am at HD or Lowes I will pay closer attention and see how many are in violation.

My guess is that this is occuring at places other than HD as well!

I have it on good authority that it is. ;)

Personally I think a change of the rules is in order.

What proposal would you suggest. 240.21 (C)??
or 240.4(F) I think it would be better handled by 240.21. I am not aware of HD's burning down I also suspect that there are a considerale number of secondary conductors in excess of 25 feet with out OCP.

Charlie I have not put a lot of thought into this but here are my off the cuff thoughts.

I would rather have the OCP up out of reach close to the transformer protecting more of the conductors.

First it is pretty unusual for these OCPs to open, if they do open an electrician is probably needed anyway as something is definitely wrong.

If the proper fuses are selected a simple branch circuit trip should not take out the fuses.

Second the buildings that have these installations often have portable means to get up to the ceiling.

That said I see the change being an addition to 240.24

Something like;

OCPDs protecting transformer secondaries shall be permitted to be installed as high as the transformer suppling the the OCPDs.

I know that is real rough but you get the idea.
