Question about nec allowing two circuits on one breaker using pigtail

Is it Legal to pigtail two 3 phase circuits together for purpose of having one wire under each lug of 3 phase breaker

You would not have two circuits any longer. It would be one circuit. I don't think it matters much if or where you split the wiring to go to two or more different loads as far as the NEC is concerned and you are in compliance with 312.8 as previously noted.
 
There is no issue with splicing in the panel as jusme pointed out with a reference to the section that applies.
 
A common violation is to have two wires under one terminal on a circuit breaker. The mfg specifies what combinations of wires and sizes are allowed and thats how UL tests. AHJs see this a lot and its an easy find for them. So if this is what you were called on, may its not so ridiculous...just saying

The oldest code I have is the 1975, and splices were permitted in the cabinet in that code, however, it was in the form of an execption to the main rule that said you couldn't. Many failed to read the exception and therefore thought that splices in the cabinet were prohibited. The rule was 373-8 in the 75 code. The failure for some code users to read exceptions is one of the reasons the language in this rule was changed to "positive" language, without an exception.
