I tell the contractors to take a level and draw a plumb line vertical from the tub edge, any space outside of the plumb line is fair game if you are asking me.
I agree!

The code has and will aways be subjective, as the printed word can be interpreted and construed multiple ways.

Common sense: Water and electricity don't mix well. Keep outlets out of the tub/shower area.

However, a well mounted TV, connected to a GFCI outside of the area, seems perfectly safe... to me.

If this were a tub only and they wanted me to add a receptacle at the same height as the light , above the receptacle serving the sink I would do it and it would not be a violation. If it were a tub only and they wanted me to install a receptacle where it is pictured in the shower stall, I would not as it is directly over the bath tub.

Pierre when you say tub edge is it the outside edge of the tub itself or the insde edge of the tub wall? I think it should be the outside edge.

I think the receptacle in the "niche" meets the requirement as it is written.

Just one opinion

Just one opinion

 Not to change the subject, but I saw a hot tub with manufaturer installed retractable tv. They claimed the assembly was listed.

Just because some one comes up with a design idea doesn't mean it is safe in all situations. The NEC is for protection of people and property, also the NEC is not a design guide.

As an inspector I will not sign my name to an installation that I feel goes against these requirments. They can always go over my head, but I will not have to defend in court why I allowed the installation to injury someone.

YUCK!... "feelings" have little to do with good enforcement In my opinion, and I hope they will and do go "over your head".

Heres an idea, install a glass panel and put a flat panel tv behind it, accessible only from the other side. Then the TV is not in bathtub area. Its the same approach to installing lighting in a spray booth, we put the lights behind windows.

Do you allow a receptacle to be installed on a vanity 12" away from a bathtub? There is the possiblity that someone might plug in a TV and set it on the edge of the tub.

My opinion is that as an inspector it is not our responsibility to enforce what we feel goes against the requirements, but to enforce the requirements as they are written.

We can't protect people from stupidity.:)
