range circuit conductors

Is there any exception to the small conductor rule
that would allow an existing no.10 NM for a residential cooktop to be used for a 40A range circuit? The homeowner is doing away with the cooktop and oven and wants to use the range only.

The branch circuit conductors must be sized for the load to be served. So you will need #8 from the branch circuit panelboard. The exception would only apply if you tap the branch circuit and serve the appliance by a smaller conductor.

Also, the branch circuit will be required to have 4 conductors. Many cooktops don't require the grounded conductor, the range does.

The 4 conductors would be 2 hots, a neutral, and a ground...right? And since the ground isn't counted in NM, it would only be 3 conductors w/ ground, right? Like some 8/3? Or am I thinking of this wrong?

Yes, you are correct. Better terms would be two ungrounded, one grounded, and one grounding (bonding).
