Sounds like you're dealing with the people that wrote it!

Here's one for you at the "reconsideration"...
Admit nothing - what lights?
Deny everything - I didn't see any lights in that ceiling.
Demand proof - Are you sure those lights were in that ceiling?

Of course the lights were never in that ceiling, they were in the other ceiling ;)
 
When i come up to people like this i would rather spend the money on a lawyer than let them win.Been to court a few times and win every time.If i am wrong i just pay up and avoid the courts.I think we would all love to see this contract,i know i would.An allowance is just that.Say you figured in $1,000 for fixtures,its up to them to buy the package for that or write a check.

I suspect I am getting into this too late to do you any good. I?ve read the other responses, and I can only offer one observation. The NEC tells us what things have to go into what rooms. It tells us, for example, how far apart receptacles can be in a bedroom and in a hallway and in the kitchen (those three are all different). It tells us when you need an overhead light controlled by a hall switch, and tells us when we can substitute a wall-switched receptacle in place of the overhead light.

If you remodel a room, then by the time you are done it has to have the minimum number of receptacles, and it has to meet the minimum requirement for light fixtures.

But the NEC does not tell us who has to pay for it. And it does very explicitly state that it gives only minimum requirements, with no assurances that the owner will be satisfied with those minimums. It does not tell us how to remodel a room, and it does not say you have to reinstall the same number of lights that the room had before, and it does not give us a minimum number of light fixtures that must be installed in any room (other than, as I said above, when it says you must have at least one). So if for example a living room (before remodel) had three overhead lights, and if the same room (after remodel) has one wall-switched receptacle (allowing you to plug in a floor lamp and turn it on with the wall switch), then the requirements of the NEC are satisfied.

So then, what or who does state what light fixtures must be installed? It might be in the building codes; I don?t know about that. But it should be in the contract.

Some customers will do anything to beat someone. Ask your electrician if he would like to get even with this guy. If he says yes go to Home Depot and buy keyless lampholders (dirt cheap)OR Temp Pigtails and put them up. Your Done, contract complete! >>> Now when he wants them changed nail him. By the way I would tell the inspector the issue and I am sure he would be happy to inspect keyless lampholders!!!
 
Ive used keyless fixtures time and time again for a final.The customer hasn`t chosen a over the cabinet fixture and there is no shower can so it is the only fixture in the room.After the final they install what they want no inspections ,no control.This is how it is.......
 
One of our GC's specializes in Restorations. When I write up a bid form him, he has me to include a fixture allowance based upon my opinion as to replacement cost back to original. He then tells the customer that they can go to the big box stores and spend the whole wad on one or all the fixtures, but any overages is theirs. Sometimes the customer just says, if the EC (me) can buy all my fixtures for that amount, then let him. (Of course, I gave them a retail price.) Only once has anyone complained that my fixture allowance was to low.

I was installing keyless fixtures on my jobs, so we could get them finaled before them special-ordered fancy-smancy fixtures could be obtained!! Sorry I didn't read your thread and offer that suggestion back then.
