Retaining Pool Screens

Pool Contractors are installing retaining screens with in 5 ft. of a pool instead of alarms per the Florida Building code.
After the cool deck is poured they drill holes in the deck and insert a nonmetallic sleeve. Then they install a aluminum pole into the insert which the screen is attached. They also make a nonmetallic pole but use a metal strip to attach the screen to the pole. I believe this is a violation of 2002 NEC Article 680.26(B)(3)and 680.26(B)(5)(1).
Any Ideas or input?

My parents have one around their pool in Lake Mary.
I think the fence is a great thing to have.

As far as Code violations, here's my opinion:

680.26(B)(3)
- I don't believe the screen fence are 'within' or 'attached to' the pool structure.

680.26(B)(5)(1)
- The metal parts are not fixed, and the fence must be removed to gain access to the pool area.

I see plenty of homes with pools that have windows and sliding glass doors which are in some cases within 5' and do not have any bonding of the metal frames. I have never heard of any reported problems.

I too think there is not much of an issue not bonding the retaining screen. Would you require an aluminum table and chairs on the deck to be bonded?
