What i'm saying is this, if we are aware of a potential problem why would we continue doing this. Remember the NEC is the minimum requirements and everyone seems to have a problem understanding this.

NEC: 358.12 Uses Not Permitted
EMT shall not be used under the following conditions:
(1) Where, during installation or afterward, it will be subject
