I know I can use romex in a multi-dwelling under 3 stories above grade but where is this in the NEC ?
Also, is romex allowed in a commercial kitchen in a multi-dwelling ?

NM can be used above three floors, you must have a pre 2002 code book.

What year code are you under?

For 2002 and 2005 see article 334

Locally we're using 2002 NEC. Article 334 doesn't specifaclly say it anymore. But I do remember it being under uses in the past. Thanks

The NEC has changed the uses permitted area to now use the building construction type. It says multifamily dwellings permitted to be of type III, IV, and V construction. These construction types are addressed in the building codes.

The best thing to do is check with the local AHJ and they can tell you if it is ok.
