Running triplex under utility primary

So I haven't heard anything back from the POCO rep, so I thought I would stir the pot so I sent this email:

Hey Jim,

Thought I would check in, do you have any updates on your end? We would like to start installing that pole and overhead like next week, and unless NYSEG can provide us with some lawful reason that gives them the authority to disallow it or that specifies clearances, we are just going to go ahead and do it. I researched the NESC, and there is language about clearances for different systems run on the same poles, but I don't see that as applying here (plus we would be exceeding those anyway).

Question.
The primaries in question over your proposed feeders, are they part of or supplying the secondaries to your feeders? If not in the same "system" I could see their hesitancy to allow your feeder under the primaries. Seems it would be a safer scenario if your feeder were attached to their pole as it would actually mitigate the potential fault event I've seen before.
Seen the damage that results when one of these primaries come down across another cable or even the road surface. If their primaries are not part of directly related to the service to your project contact of these primaries will destroy most everything on the secondary side, transformer, appliances, wiring and even personal injury, well before the primaries will trip its breakers, usually it will auto reset a few times before final trip. This setup is done to prevent total loss related to a small branch or similar coming into contact with the primaries. It will sometimes actually burn out the faulting branch and keep power "on". Have you ever noticed during a weather event the power flicker a few times then simply return, or before finally going out? This is likely what happened.
 
I'm envisioning the Large substation to substation feeds as primary but not necessarily the 250's vs secondary that run to individual transformers for the service feeds, as crossing your service feed. This not what you have?
Even the lower voltage kV ones will blast holes in the roadway but will trip out easier.

Nah, this is just a 4.8kv single phase line
 
So they guy called me back yesterday, but I missed his call and we played phone tag the rest of the day. Anyway, he left me a message saying essentially that I was right and they couldn't enforce their 30 foot corridor with nothing else in it rule. He did say because the easement gave them the right to trim vegetation and maintain the line within 10 feet (which is actually NOT what it says, maintain is used generally, and the 10 feet is specific to trimming) , he strongly requested I keep our pole outside of a 10 foot radius of theirs, which is fine, I'd like more working room anyway. So moral of the story, fight for it guys, don't let power companies or inspectors push you around.
