Different size conductors? Not a problem as long as the smallest wire size is protected.
Open knockout?

box not grounded, knockouts missing, and that looks to be Aluminum wire not terminated properly or it may be tinned coated copper.
 
tab with no screw also shows arc marks, indication of something else having been amiss...

really crappy drywall spackle ...

single wire in emt ?
 
gap around box, improper AL to CU connection, open KO, missing box screw, conductors too short, Al and CU appear to be the same size; if so, there is an ampacity mismatch there as well. Loop of bare copper looks like it goes to a screw to bond the box, tho the wire nut is in the way.

NM can be run in EMT if it is a dry location.
 
Why are some convinced that there is EMT entering this box?

The empty one does look like it could be raceway, but nothing definite in the image either.

I see no way to tell from that photo that the one with cables in it is EMT, about only thing you can tell is it is a metallic fitting of some sort.

Sure looks like an nm connector to me- you have what appears to be white nm/copper (visible just barely beside the the other cable in same connector-that little shade of white. The other nm on the left side of pic laying on top of drywall probably goes to that box) and the other cable is old black sheathed AL. That isn't going to be tinned copper- AFAIK, when tinned copper was still around, there were no egcs........

AL NM, OTOH would have an egc, as shown in ops pic.

Could also be a freak type of nm- copper cccs w/ AL egc.

Two NM in one connector? (I believe the other connector in the back is empty.)

Not a problem as long as its listed for such.:)

Not only would there been no EGC's with tinned copper, the conductors weren't as likely to have thermoplastic insulation either.
