Service Drop Conductors Touching a Tree?

I can't find anything in the code that prohibits service drop conductors. I see clearances from windows and the ground. I have a customer who is selling there house and the service drop conductors are toucing the trunk of a large tree (60-80 years old). They bend a few degrees as they pass the tree. There really isn't any other place to attach to the house that would solve the problem. Underground service is an option. Noone would want to cut this tree down. I have a call into the PoCo, but wondered what you think about this situation.

Around here the service drop is owned by the POCO and does not fall under the requirements of the NEC. If the POCO doesn't have a problem with it and it still bothers the customer they have a few options. Go underground, cut down the tree or the option that I would exercise, leave it alone.

Around here they also belong to the PoCo. I was just wondering if they were under the NEC would it be a violation. If the PoCo says they are OK with it, I would just recommend a plastic shield on the trunk to keep the wires from being grown into the tree.
