Mike,
I am not aware of a code reference that allows mixing of conductor sizes for services, feeders or branch circuits.
Are you aware of a code section that prohibits this practice? Also, 310.4 permits the mixing of conductor types within a circuit.
There is no code section that can be used to prevent this installation as long as the conductors meet the ampacity rules and other such requirements. There is no code or electrical problem with this installation. Any inspector who would red tag this installation is wrong and overstepping his/her authority.

techresource, very good question. If you read art. 310.4 you'll find the anwser. It all depends how you run your wires.
