If a service coming to a bldg comes to a main lug only distribution panel ( mdp) and it has 8 means of disconnect but is only using 6 to feed other panels is it compliant?

No, six moves of the hand must remove all power from the building, outside of exceptions for things like fire pumps, emergency systems, systems with different voltage, etc.
 
What are the two that don't feed other panels? Main for other sections in same gear? Main for primary of transformers? Both of those would need to be counted in the six disconnect rule.

What if they are spare breakers and do not energize anything?

Oh boy, this situation is baiting and just about entraping the inspector to say, "what if someone connects something to the 7th and/or 8th breaker?" ;)
 
That is my concern. This is a remodel. The xfmr sits on the pad and the SEC feeds down to the below ground level floor with offices and the electrical room where the service equipment is. The enclosure takes up almost the whole room.

If the spaces were there but not the breakers, I would say no problem.
With the breakers there but unconnected I would not expect the AHJ to accept a situation where someone has to read the stickers to see which six throws will disconnect the service. Maybe if the breakers were locked in the off position?
But why not just remove them?
 
I may be using the wrong terminology. They are fused disconnects. (buckets)
I can remove them. Then Ill have to find the metal blanks to cover the spaces.

I might ask the AHJ whether it would be acceptable to lock them in the Off position. Likely the answer would be no, but it would not hurt to ask.

Why would you expect the next electrician to violate the code?

Why couldn't the inspector fail it at that time?

Don't create a violation to appease an inspector that has no code reason to fail this job.
