Single Pole CB in Upper Section of Split-bus Panel

Got a call from a friend (electrician) today asking if he could put a single pole CB in the upper section of a split-bus panel. I told him I couldn't think of any violation as long as it stayed under the 6-disconnect rule and the panel instructions didn't prohibit it. Did I miss anything?
