Stairways(wells)

My company is installing the electrical in the renovation of a level, and the stairway, of a 5 story building. We were told by the contractor that 'by code' the only electrical wireways(conduits) that may be in the stairway must pretain to the stairway. I'm not arguing on whether to run the wireways threw the stairwell or not, if the contractor doesn't want it, it won't happen, what I want to know is where in the code is this? I, and a few co-electricians cannot find this in the codebook.
 
Not in the NEC 2005 , unless its in local building code. More then likely GC doesn't want to see it there or is mistaken.
 
That requirement is in many of the building codes. We should problably add it to the NEC to avoid confusion.

2000 IBC which we are currently under here 1005.3.4.1 regarding penetrations INTO the stairwell...Penetrations into and openings through an exit enclosure assembly are prohibited except for required exit doors, equipment and ductwork necessary for independant pressurization, sprinkler piping, standpipes and electrical conduit serving the exit enclosure and terminating at a steel box not exceeding 16 sq. inches. Such penetrations shall be protected with section 711 in the IBC

If you need to install raceway in the exit stairway, you could enclose it with a properly rated enclosure to essentially make that soffited area "not in" the stairway.
