T8 LED replacement violates NEC?

There are many new manufactures of LED replacement or retrofit lamps. I recently saw a product that had the dc converter built into the lamp. For a T-8 retrofit, the instructions are to cut the red and blue ballast wiring from the ballast and to connect the 120 or 277 line voltage to the existing red and blue wires going to the tombstones.
Is this a violation of the NEC? The fixture was a listed assembly, but now has been modified. The existing wires to the tombstones is not sized to the 15 or 20 amp circuit.
Once a listed fixture is modified, isn't all work required to be per NEC standards or the fixture needs to be re-listed?
