No, this is not an NEC issue.

Each individual state will govern this requirement through the Department of Children and Families. In most cases, after market products are permitted, such as plastic plug-inserts.

Also could be in the job specifications. :)

I wired a Daycare center of a national chain and the job specs required tamper resistant outlets.

Hubbell makes a nice one but they are not cheap.

By the way when looking for these use the term 'tamper resistant not tamper proof. :p

To expand on this, there is an NEC requirement for tamper resistant receptacles in Pediatric Locations of Health care facilities

517.18(C) however a typical daycare center will not be in the scope of 517 IMO.

life safety code NFPA 101 section 16.5.1.2
states protective covers for all receptacles shall be installed in areas occupied by clients

I don't think that NFPA 101 section is refering to Tamper Resistant is it?
