BTW, I believe TR's are a requirement for new construction only and not remodel work. If I'm wrong someone please correct me.
There is nothing in the 2008 NEC that would only require tamper resistant receptacles in new construction and not remodel work.
Also the 2011 NEC expanded and now specifically requires replacement receptacles to be tamper resistant in areas that require tamper resistant receptacles. (See 406.4(D)(5) 2011)
