Just a question to your reply, if the main panel with the ocpd is located next to the transfer switch would the main panel have to be treated as a sub panel with seperation of the egc and the grounded conductor.

Yes.

A Service rated transfer switch used the way the OP describes becomes the service disconnecting means. The grounding and bonding is required at this disconnecting means.

The enclosure containing the OCP will be treated as a sub panel or any load side equipment.
