Can somebody translate this into English?

i. Codes and standards referenced in the Fine Print Notes (FPNs) of the electrical subcode (NEC 2005) shall be considered adopted by reference to the extent prescribed by each related section. These codes and standards also are printed in DCA Bulletin #05-2, which contains a list of adopted codes and standards that are applicable to the enforcement of the electrical subcode.

Is this saying FPNs are now "code" (in NJ ONLY) ?

What I believe they are saying is that some of the standards that are mentioned in the FPNs as referenced are also adopted by the NJ as codes. Remember the NEC is a standard and is adopted by NJ.


Each state treats this a little differently.
The list of adopted standards is usually in an appendix at the back of the document.
 
After reading the document it appears that it is only making a change from the 2002 NEC version to the 2005 version. I don't think they really mean that the FPN's are enforceable.
 
When we do patenting work, we use the term 'incorporated by reference' to legally mean that the referenced text is to be considered part of the current document.

I believe that what the above is saying is that if a FPN actually refers to another code (as opposed to simply making a suggestion), then that other code is automatically adopted to the extent applicable. So for example, the FPN under 505.4(A) would make a bunch of ANSI and ISO standards for classified location part of the enforceable code, but the FPN under 210.19(A)(1) for voltage drop remains a design suggestion.

But what the hell, I am not a lawyer :)

I actually used that to my advantage. I am working on the design for an industrial facility. The client is a @#$%^.

They wanted strip fluorescent on 50 ft centers and 50 ft off the end walls!

I told them it did not meet code, engineering practice, and recommendations and that I would not put it on my drawings and would not put my name on such an inferior design. We met for 3-3/4 hours over this. The next week I got an e-mail with them still trying to "prove" that what they wanted was ok.

No, I will not do that!!!
