If your Available Fault Current is greater than the breakers installed then the installing would not meet Code. Manufacturers can "series rate" breakers with different AIC ratings.
Let's assume the AIC at your panels is 22k. If the 1st panel, manufacturer A has 10k rated breakers that series rated with that main (mfg A) then panel A would be legal. With Panel B being protected by Panel A's main
those breakers (manufacturer B) would not "series rate" with Panel A main and therefore would not meet Code.
When depending on series ratings you can not cross manufacturers.
 
Probably be ok if the specs work out on the panels. I do think it will look cheap and customer might question it. You did your job my letting the boss know. Its now up to him and if it goes south the blame is on him. The changes should be ran pased the eng.,a sharp inspector might call you on it and want letter from eng.. Could turn costly.
 
I don't see any code issues or listing issues. You are just installing two panels with one feeding the other. As long as you don't violate any other code rules you are good to go. There is no need for a listing as a two section panel and the second panel is just that...a second panel.
