type 5 mc or romex

Can anyone direct me to the section covering wiring requirements for an apartment complex over three stories from grade. I am being told that mc is required. The city is on 2002 code. It is a 4 story type 5 senior apt. complex with ada requirements. I was under the impression the code excluding romex was changed in 02 for type 5 structures. Any input would be appreciated. TIA

See 334.10 and Annex E in the back of the NEC. a note at the top does indicate that the Annex is not code, but rather, to be read like an FPN.

This annex is not part of the requirements of this NFPA cocument but is included for informational purposes only.

Unless there is a local code prohibiting it, it is allowed per the NEC, your inspector may not know it.
