Type NM Cable uses not permitted (Art. 336-5)

We are currently looking at a hotel job to bid on. Some of our peer contractors were recently telling us a way to save money is to use Type NM cable on the floors three and under, then use type MC cable on the upper floors. I do not think this will meet code requirements, but am I missing something. It looks to me like you may not use NM cable in ANY part of a building which exceeds three floors above grade.

Who is right??

With the code reference you gave, you must still be under the '99 NEC. You can not install romex in a building that is over 3 stories in height. That was changed in the '02 code. If you have the '02 book see 334.10 & 334.12 for uses permitted & not permitted. Ron

Thak you very much for your kind words, they mean a lot to me :) . I think what needs to be addressed first, however, is which cycle of the code the installer is on, as Ron stated. I agree with Ron's take, that under the 99' this would not be permitted in any portion of a building that has more than three floors.

If were in 2005 why can I not put in nm cable in a building? I personally feel the lack of the ahj to update more quickly with the national code is a shame. I know that if there is a code that has been added to the newest code cycle and I see it as a safety factor I will install it ie afci breakers. Yes I may not get the job however Id rather be safe then not. So why cant the ahj do the same and get up to speed with the code

If the 2005 code permits something that the jurisdiction that does the adoption doesn't like (in Indiana, the jurisdiction that adopts the Code is the State) and they decide to disallow it, then do you have to go back and rewire all the buildings that you did incorrectly? That sure is a long sentence isn't it? :D
