Type NM in basements

Here's one we see a lot as an inspection agency. Electricians run romex on top of the concrete foundation wall around the perimeter of an unfinished basement. It' supported and not subjected to physical damage being up on the "shelf" formed at the top of the foundation wall. I looked in 334.15 and can't come up with a reason why not. Any suggestions or comments? Thanks.

Are they using Tapcons to secure it? ;)

If it is stapled to the sill plate(not the bottom of the joists), it is ok(with the structure). If it is "laying" on the wall, no.
