Could rule #3 come to mean that there must be no violations in the service equipment in order to add a circuit of any kind????

this is an interesting statement butr I don't follow??

I do not believe that there is a specific requirement restricting a tap from an existing load center to new one which will accomadate AFCI where needed.

Or have I missed your point?

Perhaps my point in regard to rule #3 is misplaced .... but it stems from the phrase ; ..." or increase the magnitude of an existing violation "

My brother has a 60 amp service ,.. can I add to it ??? does adding to an already undersized service not increase the magnitude ???

I thought I knew what the phrase meant but the more I think,...(and there in lies the problem ,..me thinking)... about it the less I understand it's limitations when there is an existing violation

Yes you can. They make a DP arc fault. That works on a MWBC. Besides you need to figure all that into the equation before you install an outlet.

Has anyone started making a combination type AFCI double pole breaker ? I have only seen Cutler Hammer in DP and they are not combination type.

Ok the story goes on.........
I work for the GC. He has paid me on time and even given me a few extra bucks here and there on this project. Everyone is waiting for a final payment from the GC who is waiting from the home owner. It hasn't been 30 days so I will wait. And I get alot of work from this GC. He got a check today so I will get my final payment tommorow.
I wanted my payment and the customer wasn't paying do to these 'code violation' that didn't exist.
The home owner is holding back $150......... for payment for the electricain they hired to inspect my work and they wanted to reuse a light fixture that was removed and got damaged.....
I talked to my lawyer, they do not have a home stead on the house......and I think I will put a lien on the house for the $150... my cost for this will be $85. I was informed that even though I work for the contractor I can put a lein on the customers house.....even if this just holds them up from getting a refi in a year or 2 it will make me feel better. What comes around goes around.....

Dude let it go, you will live longer. It is a decision that should be based on money alone. If it cost you $85. to file and the time it will take, that will make it not worth your time. Beside the fact the GC is not going to forget that YOU could not let it go and may think about a new electrician. Is that worth the $65 you may get in 2 to 30 years ?????????????? Being right can be costly.
