Use of Non-Plenum rated Data cabling where a non-plenum A/C system exists.

Per the NEC 2002, can non plenum rated voice and data cabling be used in a building with non-plenum ceiling and A/C distribution. If so, where is this addressed in the NEC ?:happyyes:

What do you mean by a "non-plenum ceiling and A/C distribution"?

Does the A/C utilize the above ceiling space for return air or not?

If it's not being used for RA, then it's not a plenum, so plenum cabling is not necessary.
