Using Bus Duct with tap rule

If you keep tapping off of a bus structures with the same size bus does the tap rule even come into play?

For instance lets say I have a 400 bus. I then tap this bus with another 400A bus to form bus #2. I then tap bus #2 with another 400A bus to form bus #3. Since its the same size bus do we need to be concerned with the tap rule as long as our upstream protective device is less than 400A? In other words this wouldn't be considered "tapping a tap"?

Would tap rule only come into play if we were tapping busses with cables or buses of a lesser size than the origonal bus?

No.
Article 240, says a connection is a "tap" only when the conductor is 'undersized' compared to the upstream protective device.
