Please see pic below. Is this a violation? I can't decide if 110.26(3) permits this.
I'm inclined to say it's a violation but I'd like to check.

This might be a long shot... but does 404.8(A) apply to your situation? (with regard to the panel... not the disconnect)

I agree with Dennis. I would add that one could not be more than 6" deeper than the other.
