Water Heater Wiring

I have just been to a house and they installed a new 40 gallon electric water heater. It draws less than 30 amps. They have a 50amp double pole breaker and have 8/2 wire running from panel to the disconnect box. Then 10/2 wire from disconnect to water heater. Is that fine on that breaker as the water heater doesn't draw that much amperage? Thank you. David
