The current situation as simplistic as it can get:
two wires of different sizes are connected together to feed a panel. So 1/0 AWG connected to #6AWG and this occurs inside the panel. THe #6 awg is then connected to a main breaker of 40 amps.
I don't know how else to explain this.

Sounds like a feeder tap situation. You'd need to tell us what the feeder OCPD is, how far away it is, and how the conductors are protected.
plus there may be other factors I am not considering off the top of my head.
More information is what is needed.

As long as there is the space required by 312.8 and the connector is listed for those two sizes of wire, I don't see any problem. Even if the 1/0 is protected at its maximum permitted ampacity, there would be no problem with the tap rules.
