Wireway covering requirements

We are having an internal dispute over whether a sheetmetal wireway filled with type TC tray cable and having a hinged access cover is in violation of the NEC if the cover is left open or is removed. The wireway and cable are not situated where they would be subject to damage with the cover removed.

Article 376 does not specify that the wireway must be covered, as 366.100(D) does for Auxilliary Gutters. In fact, 376.10 (1) states wireways are permissable "for exposed work."

My position is that leaving the covers open or off is not a good practice, but it is also not a "Code violation." Others at my workplace disagree. I'm throwing it out to you Code-gurus - you never lead us wrong! What do you think?

376.2 Metal Wireways. Sheet metal troughs with hinged or removable covers.....

IMO: A sheet metal trough without the cover is no longer a wireway. I would consider it a violation just like removing covers from jboxes, or fittings would be.

The UL listing for the wireway probably also requires the covers, but that's just a WAG.
