They could have left it out. ...
I had a proposal on this issue and the CMP said that "require" does not mean "require" but they would not remove the word.
 
Maybe look at it this way.

The disconnect switch is a required convenience, but there is likely a way to get around everything that you might otherwise do with the the switch while its door is open and energized. It might not be a convenient way to handle it, but you can probably find a way.

I don't see any way that you can meet the working space requirements unless you space them off the wall and dig a trench for the pipe and wire and that will look really ugly.
 
If it makes you feel any better, I'm having some issues finding an HVAC guy who has even the slightest interest in doing a neat, professional job. I'm a whisker from gettin my own 'freon license,' taking on the entire job, and just letting the HVAC hack do the line connections. These guys don't want to do anything more than drop it and run; no concrete pqads, no steel cages, no running lines under the building when you can crawl up the side and punch through the attic.

Yeah, it's hard to find professional workmanship HVAC folks. I've considered getting an EPA license too.
