Wrong application

I have a guy who wants to use type SER cable instead of type SE cable and just cut off the extra conductor that he doesn’t need. Besides this being stupid where does the code back me up?

Don't think it does....

There is no code issue with having an extra conductor in a cable. The only issue is that 110.14(B) requires that "the free ends of conductors shall be covered with an insulation equivalent to that of the conductors or with an identified insulating device."
