my company installed a condensing unit that has max. fuse size 45, min. ampacity 28.8, we installed a 40 amp breaker, the inspector turned us down and made us install a 45 amp. I say he is wrong.
 
If it says fuses then you can't use a CB you must use fuses.

The OCPD can be any size between the MCA and the Maximum size listed on the unit. What code article did the inspector cite as a violation?
 
yfacm what was his reasoning the startup of the motor is already factored in. What size wire did you guys pull? Sounds like another genius inspector. See my post for some more info on acs. And welcome to this site

I will assume you mean fuse or cb and not just fuse-- In this case the inspector is incorrect. The 45 amp is the max you can use but you may use any size larger than the min. cir. ampacity.
