I will bet that is USE inside that plumbing pipe sleeve which would be another violation ........ at least under the recent codes.

I'd call it a toss up as to whether it is even a violation today unless you are claiming it is subject to damage, which is always a judgment call. Even then the code allows for unlisted things to be used to protect the USE.

(4) Enclosure or Raceway Damage. Where the enclosure
or raceway is subject to physical damage, the conductors shall
be installed in rigid metal conduit, intermediate metal conduit,
Schedule 80 rigid nonmetallic conduit, or equivalent.
Who gets to decide what is equivalent? Who decided that back in 1984?

What exactly forbids running USE inside?

The 2008 NEC code section I quoted.

Are you saying if you have an underground service cable it has to terminate outside?

If I use type USE it must terminate outside.

Unless it is 'dual listed', type USE has not passed the required flame resistance tests to be used indoors.
