Although the jacket may not qualify as an EGC it still is required to be grounded which means that it needs a proper connector to attach it to the panel enclosure.
 
312.5(C) Cables. Where cable is used, each cable shall be secured to the cabinet, cutout box, or meter socket enclosure.
 
There are numerous ways to do this in a code compliant manner, the one depicted in the photo isn't one of them. :)
 
How come you are not connecting the MC cable directly to the panel ?
 
It looks better than the first photo and it seems to be code compliant, however I would suggest using Erico Caddy CJ6 MC Cable supports to strap that MC. It is a much quicker than screwing to the inside of the studs and it keeps the cable far away from the drywallers' screw guns.
