125 % or 80 % of breaker

CM called me yesterday an inspection friday was tagged on final oversized breaker on 3.6 kw wall oven.Trim man called me and I told him to use a 25 amp 2 pole.Since 3.6 kw calculates out to 18.75 amps.At 80% that requires a 25 not a 20 he wrote should be there.I`ve never figured a wall oven/cooktop to fall under 3 hour continious usage rule that would allow a 20 amp breaker :mad:

210.23 (A)(1) Cord-and-Plug-Connected Equipment. The rating of any one cord-and-plug-connected utilization equipment shall not exceed 80 percent of the branch-circuit ampere rating.
Maybe he his looking at this requirement?

3600W divided by 240V = 15A
20A breaker at 80% = 16A (15A times 125% = 18.75A rounded to 20A)

Is it cord and plug connected? Most wall ovens I have seen are hard wired. A thermostat would not let it stay on,(with continuous load) for three hours anyway.

Hard wired and that is what I say,with a thermostat non continious load so 80%.
