What part of this is not an appliance do you not understand?
 
Even if the AHJ insists on applying 422 (which I agree they should not), those requirements can be complied with using a breaker padlock device in the panel, at most. There's no requirement for an additonal disconnect at the appliance.
 
It is not, as an EVSE is not an appliance, as it is not utilization equipment.

An EVSE is definitely not utilization equipment. An EVSE is a smart power switch, basically a special function GFCI.
It's functions are to monitor ground continuity upstream, measure residual current downstream, advertise available ampacity,
and shut the heck up when no vehicle (or device faking a vehicle) is present. All analog tech, pre-digital design.

It's freaking smart relay.
