Conduit penetration

Instead of penetrating through the fire wall, an electrician has wedged the conduit(1/2"EMT) through the narrow gap seperating the top of the fire wall from the metal ceiling. Does anyone think that this could be a NEC or building code violation? I don't have a photo to share.
 
Are you talking about the trapezoidal shape in a corrugated deck? #1 where does the rated assembly stop is there to be a rated ceiling? #2 08' NEC if that is the roof deck then that could be a problem 300.4(E)....I am just assuming here.

Yes, the conduit runs in the V-groove, and the wall stops at the roof deck.
 
If none of the other holes have fire stop I don't see how you could require him to fire stop his conduit. Seems pointless. To me it seems like the firestop plan has issues with allowing those holes to exist. If they are allowed by your plan then the electrician didn't violate any rules by not fire stopping.
