Surface Mounted Box. Where the box is mounted on the surface, direct metal-to-metal contact between the device yoke or a contact yoke or device that complies with 250.146(B) shall be permitted to ground the receptacle to the box. At least one of the insulating washers shall be removed from receptacles that do not have a contact yoke or device that complies with 250.146(B) to ensure metal to metal contact. This provision shall not apply to cover-mounted receptacles unless the box and cover combination are listed as providing satisfactory ground continuity between the box and the receptacle.

A cut in box is not a surface mounted box when used as intended. It is that simple.

We know what surcface mounted means, ans is not what you have been describing.

By your logic a "recessed" light would actually be a "surface" light. It just is not.

The issue is the wording changes as described - and something I took little notice of in the 2002 code change. As 1999 the wording for that code was "On or at the surface" and clearly allowed. What I have been looking for is why this change occured, and for what purpose. Although at the time there was no wording for any ground to the device at all if "at the surface" - cut-in box, or from a mud ring, or bracket mounted box. So which was it? To get rid of not using and EGC at mud rings, or bracket mounted boxes, or cut-ins, or both? And yes - local interpetation depending on who you talked to, was that cut-ins were mounted on the surface, and therefore allowed - as they were in the past..... And where as a mud ring to a box mounted with a bracket was not....

My next book before 99 was 93 and this code does not even exist in it.... So I'm not sure how the wording got in there????

But after long last.... I think I have found the answer - on page 65. Both were listed as ROP's one was accepted.
