Correction it is the 99 that says , "ON or AT" (the surface). Some other day I'll go dig for the 93....
The issue is the wording changes as described - and something I took little notice of in the 2002 code change. As 1999 the wording for that code was "On or at the surface" and clearly allowed. What I have been looking for is why this change occured, and for what purpose. Although at the time there was no wording for any ground to the device at all if "at the surface" - cut-in box, or from a mud ring, or bracket mounted box. So which was it? To get rid of not using and EGC at mud rings, or bracket mounted boxes, or cut-ins, or both? And yes - local interpetation depending on who you talked to, was that cut-ins were mounted on the surface, and therefore allowed - as they were in the past..... By your logic a "recessed" light would actually be a "surface" light. It just is not.
